1) The Executive Branch does not have the authority/power to spy on Americans without a warrant in order to stop the war on terror because it is unreasonable search and seizure to the American people along with a violation of privacy. is a violation of privacy as well as being prevent future terrorist attacks on the United States because this would result primarily in a violation of the right to privacy and right to no unreasonable searches or seizures.
